Lucy became a tenant at Parklane Plowden Chambers in 2008 after successfully completing her pupillage.

Lucy practices as a member of the Personal Injury and Insurance groups, undertaking cases for both claimants and defendants. She is also a member of the Employment group and is happy to accept instructions in all areas of employment law.

Lucy is part of the Education team and is keen to develop her practice in this area. She is happy to accept instructions on behalf of local authorities, governing bodies of all schools, colleges and universities and individuals.

Lucy believes that the range of skills and the experience she has gained in each area of law in which she practises is of benefit to her clients in her other areas of practice.

Areas of Expertise

Lucy practices in all areas of personal injury litigation.

She has experience in a variety of forums including the Coroner’s Court, the County Court and the Criminal Injuries Compensation Appeal Tribunal.

Lucy regularly appears in Court at interim hearings as well as trials representing both Claimants and Defendants and is happy to accept instructions on a conditional fee basis.

Lucy also provides advice and has an extensive paperwork practice drafting pleadings, advices and skeleton arguments.

Inquests

Lucy frequently represents interested persons in inquests arising out of road traffic accidents and accidents at work where there is a potential civil action in the background.

Road Traffic Accidents

Lucy has extensive experience in road traffic accident claims.

She represents both Claimants and Defendants at all stages of claims, undertaking advisory, drafting and advocacy work in a multitude of cases on the small, fast and multi-track.

Her experience ranges from factual and legal liability disputes through to more complex quantum issues.

Public, Product & Occupiers Liability

Lucy regularly advises in a wide range of Public, Product & Occupiers Liability claims, appearing on behalf of both Claimants and Defendants.

She has experience in holiday claims as well as those concerning the Consumer Protection Act and the Defective Premises Act.

She also regularly acts on behalf of local authorities in both slipping and highway tripping cases.

Employers Liability

Lucy has a comprehensive understanding of all issues of employer’s liability and undertakes advisory, drafting and advocacy work.

Credit Hire

Lucy has significant experience in the area of credit hire litigation and regularly represents insurance companies in relation to both Fast track and Multi track cases, having developed a strong Defendant practice. She is knowledgeable on a number of aspects of unenforceability, including the Cancellation of Contracts made in the Consumer’s Home or Place of Work Regulations and subrogation arguments, together with the usual issues surrounding need, duration, impecuniosity, rate and the like.

Motor fraud

Lucy undertakes cases for both Claimants and Defendants, having dealt with cases of this nature on both the fast and multi-track, involving issues such as low velocity impacts, phantom passengers, staged accidents and induced accidents.

In addition to regular appearances in Court at trial, Lucy has extensive experience of dealing with preliminary issues relating to such cases at interim hearings.

Litigation Funding and Costs

Lucy is experienced at dealing with Costs and Case Management Hearings and she is able to deal effectively with the new costs arguments arising out of the Jackson reforms.

Lucy regularly appears in the Employment Tribunal, representing both respondents and claimants in all aspects of employment work.

Lucy regularly appears at preliminary hearings dealing with jurisdictional issues and time limit issues in discrimination cases as well as other preliminary matters and she is also regularly instructed in multi-day final hearings in discrimination, whistleblowing and unfair dismissal cases.

Lucy regularly acts for NHS Trusts, Care and Residential Homes, large commercial employers, local authorities as well as various trade unions and their members. She is also instructed to deal with judicial mediations.

She receives instructions from firms of solicitors around the county and is also accredited to accept instructions on a Direct Access basis.

Lucy is experienced in and happy to accept instructions in all areas of employment law, including:

Very recently concluded cases include:

Representing a social enterprise with Charitable status run by a Management Board of disabled people providing a variety of support services for disabled people in a claim for unfair dismissal following gross misconduct involving threatening and abusive language and behaviour within the workplace.

Representing the Respondent NHS Trust in a multi day case concerning a claim for unfair dismissal, direct discrimination (disability), discrimination arising from disability and failure to make reasonable adjustments.

Representing the Respondents in a claim for pregnancy discrimination and discrimination arising from disability following the provision of a reference which was alleged to be unfavourable and where the protected characteristics of the Claimant were inextricably bound up with each other.

Representing the Respondent NHS Trust in a claim for unfair dismissal following gross misconduct of a long-serving senior Nurse involving taking extended breaks and sleeping on the Night Shift as well as self-administering prescription drugs which had also led to referral to the NMC.

Representing a Claimant in an unlawful deductions claim against the Respondent for failure to make payments in respect of his entitlement to paid annual leave over the course of his ‘employment’ with the Respondent.
