Gemma has a mixed practice which encompasses Clinical Negligence, Personal Injury and Court of Protection. She also has an interest in appeals to the First-tier Tribunal (Special Educational Needs and Disability). She is most often instructed to attend court in the North East of England, in particular Newcastle Upon Tyne, Sunderland, North Shields, and Middlesbrough (Teeside).

Gemma undertakes work arising from cases of surgical and pharmaceutical negligence, misdiagnosis and delayed diagnosis, inappropriate treatment and lack of consent. She regularly advises in claims with losses of up to £500,000, and recently had a case settle for £950,000.

Gemma also undertakes personal injury work for Claimants and Defendants in all areas, including Occupier’s and Public Liability, Employer’s Liability, Industrial Disease, and Road Traffic.

Gemma is a member of the Personal Injury Bar Association (PIBA) and Action Against Medical Accidents (AVMA)

Whilst away from court and her paperwork practice, Gemma enjoys all manner of hobbies including crafting with her children, a sporadic yoga practice, and mastering the art of chicken husbandry. She has recently raised money doing a daily run in order to raise money for Great Ormond Street Hospital. She hates running.

  • Gemma always aims to provide professional and friendly support to the individual that she is representing. She always attempts to put clients at ease as much as possible in a setting which is largely unfamiliar to most.

 

  • Gemma has also undertaken cases concerning Product Liability

Gemma is a confident and approachable senior junior with a busy civil practice. She is happy to accept instructions on behalf of local authorities, governing bodies of all schools, colleges and universities and individuals. Gemma is part of the Education team and is keen to develop her practice further in this area.

Gemma has a history of work in personal injury and clinical negligence cases which has given rise to a natural interest in health and welfare cases under the Court of Protection.

She has acted for Local Authorities in cases before all levels of the judiciary concerning the rights of people covered under the Mental Capacity Act 2005 and the Mental Capacity Act 1983. Recent and ongoing matters include:

  • Representing a local authority in proceedings where P’s no longer has capacity to make decisions regarding her residence and care in circumstances where the family believed she would wish to reside at home.
  • Representing a local authority in proceedings for 17 year old accommodated under s.20 CA 1989 agreement to move to permanent accommodation.

Gemma can provide advice to both Claimants and Defendants in Industrial Disease Claims.

She has had conduct of cases concerning:

Hand and arm vibration syndrome, latex allergies, asthma, and industrial deafness.

  • Gemma is instructed in a broad range of clinical negligence work by Claimants and Defendants.
  • She advises in claims concerning the negligence or purported negligence of doctors, dentists, nurses and other allied health professionals.
  • Gemma regularly advises on both liability and quantum, including high-value claims, complex future loss issues and Fatal Accident Act claims.
  • She often appears in case management hearings, interim applications, along with drafting pleadings and advising in writing and in conference with experts.
  • She has experience in obstetric and gynaecological claims, missed and delayed diagnosis of cancer and orthopaedic injuries.
  • Gemma has also acted on behalf of both Claimants and clinicians in claims arising from elective aesthetic surgery and procedures including breast augmentation, rhinoplasty and a liposuction.

Gemma acts as an inquest advocate, appearing on behalf of both families and healthcare providers in inquests involving hospital and mental health settings, prisons and the community. Gemma has experience of representing parties in front of juries and in Article 2 inquests.

In respect of her Clinical Negligence practice, by way of example, in the last 12 months Gemma has advised on, and assisted with the settlement of cases for Claimants who have suffered from the consequences of:

  • Undiagnosed pancreatic cancer with terminal metastases;
  • Undiagnosed pituitary gland tumour, including acromegaly;
  • Undiagnosed tears of the anus, as well as fistulas created during labour and delivery;
  • Perforated artery during laparoscopic procedure;
  • Poorly performed breast augmentation surgery with substandard outcome.
