Hylton Armstrong

Hylton is a specialist personal injury and clinical negligence barrister, recognised by Chambers & Partners and The Legal 500 as a leading practitioner in both fields. Over the years the directories have described Hylton as ‘intelligent’, ‘calm’, ‘client-focused’, ‘unflappable’, ‘authoritative’, ‘brilliant in court’, ‘a superb advocate’, and ‘an excellent all-round counsel’. Hylton is instructed by claimants and defendants in high-value, complex, and sensitive cases frequently involving difficult issues where critical thinking and careful strategic judgment are key. He is regularly instructed in matters requiring the coordination of multiple expert disciplines and the management of legally and medically intricate issues. Hylton is often relied upon to shape the direction of cases from an early stage through to trial or settlement. He appears unled in the High Court and County Court, and is experienced in handling contentious trials, difficult expert evidence, and high-pressure settlement negotiations, including mediations and joint settlement meetings. Hylton has also developed a growing specialism in amputation claims, acting in both personal injury and clinical negligence matters for both claimants and defendants. Through this work he has gained invaluable experience of the issues which arise in such cases and is familiar with many of the experts who work in this area. Hylton believes early strategic input and careful handling of the injured person’s rehabilitation are central to achieving the right long-term outcome. Specific recent examples of trial advocacy include acting for a Claimant in a case involving an alleged misdiagnosis of cancer, acting for a Claimant in a case concerning an alleged failure to stabilise a displaced fracture, acting for the Defendant in a case concerning an alleged failure to remove a retained palatal root, and acting for the Claimant in a case involving a negligent failure to urgently refer a patient to the crisis team which resulted in his suicide. Recent examples of Hylton securing high-value settlements for protected parties include a settlement approved by Mrs Justice Ellenbogen following the death of a women who died due to sepsis caused by chicken pox, a settlement approved by Mr Justice Soole in a liability disputed case about a potentially preventable suicide, a liability split approved by Master Stevens in a high value brain injury claim, and a settlement of £4.6m approved by HHJ Gargan sitting as a Judge of the High Court in a liability disputed claim about a devastating hypoglycaemic brain injury. In addition to his practice, Hylton has held several senior leadership roles within chambers including as former Head of our Clinical Negligence and our Serious Injury groups. He is also a regular pupil supervisor, advocacy trainer on the Northeastern Circuit, and member of the Personal Injury Bar Association Executive Committee. In addition to his work as a Barrister, Hylton also sits as a Recorder and Deputy District Judge, and as a barrister member of the Bar Tribunal Adjudication Service disciplinary pool.
