Alisan advises on all aspects of coronial law and appears at pre-inquest review hearings and final inquests. She represents a wide range of Interested Persons, including bereaved families, the Ministry of Justice, local authorities, other public bodies and professional clients.

She has particular experience of Article 2 and jury inquests arising from deaths in prison. She is experienced in dealing with issues of scope, disclosure, witnesses, neglect, causation and Prevention of Future Deaths reports.

Alisan’s earlier personal injury practice equips her particularly well for inquests involving road traffic collisions, workplace deaths, clinical treatment and serious injury. She combines detailed analysis of medical and documentary evidence with sensitive handling of bereaved families and witnesses.

Alisan practises across the Court of Protection jurisdiction, with experience in health and welfare proceedings and a developing property and affairs practice. She represents public bodies, family members and other interested parties. She is available to advise and provide representation at all stages of proceedings.

Health & Welfare

Alisan is regularly instructed in applications under sections 16 and 21A of the Mental Capacity Act 2005 concerning residence, care, contact and deprivation of liberty. Her work includes increasingly complex disputes about P’s capacity and cases requiring careful scrutiny of capacity assessments and expert evidence, particularly the ability to use and weigh relevant information and the distinction between an inability to decide and an unwise decision.

She also acts in serious medical treatment matters and urgent applications concerning conveyance, changes of placement and restrictive care arrangements. Her civil litigation background is particularly valuable where cases involve complex evidence, safeguarding concerns or an overlap with personal injury and public law.

Alisan advises and represents in proceedings concerning attorneys and deputies. Her experience includes the scope of an attorney or deputy’s authority, suspected financial abuse or misappropriation of P’s funds, revocation of lasting powers of attorney, the appointment or approval of professional deputies, and applications for statutory wills.

Inquest touching upon the death of Sheila Edwards

Represented the family in an Article 2 inquest concerning a fatal road traffic collision caused by a driver who had not notified the DVLA of cognitive decline. The case was considered alongside related deaths involving older drivers who had failed to report relevant medical conditions. Prevention of Future Deaths reports were made concerning the DVLA's self notification scheme, and the cases received national media coverage.

Inquest touching upon the death of Alex Crook

Represented the father of a 15-year-old boy who drowned while swimming at a local beauty spot. The inquest examined the provision of mandatory swimming lessons and the opportunities available to pupils who could not swim safely.
