During the trial, a number of practical issues arose about the absence of written and oral witness evidence. Howard and Megan will discuss adverse inferences that might be drawn against a party who fails to call an important witness, what to do when an important witness is unable attend trial in person and also cannot give evidence by video link, “chaotic” consenting, and the catastrophic failure of a surgeon to prepare for a serious, foreseeable risk in a major operation.
