Barristers will deliver a series of webinars covering the family law legal issues of the moment. 

November 

Wednesday 4th November at 5pm.
Topic: 
Six degrees of alienation: when does the child’s welfare demand a transfer of residence? 

An analysis of case law and the guidance on parental alienation and how they can be applied to everyday cases.

Monday 9th November at 5:30pm.

Topic: Child Marriage Bill.

Natasha Rattu, Executive Director of Karma Nirvana, together with Payzee Mahmod, Campaigner against Child Marriage, will discuss the Bill soon to have a second reading before the House of Commons: seeking to change the law that currently allows 16 – 17 year olds to marry with parental consent in England and Wales.

This webinar will include:

  • Overview of the end child marriage campaign – how it started, where it is now and how people are supporting it.
  • The proposals – the current gaps in the law and how the bill proposes to change this.
  • Case examples
  • Crucially, Payzee Mahmod’s personal testimony about the impact of child marriage.
  • Time allowing, some audience discussion.

The impact of COVID-19 on Threshold Statements: now and and in the future.

Lucy and Donna will discuss what is happening in practice during COVID, including the threshold being satisfied on other grounds and avoiding litigating issues. They will also consider the implications that COVID-19 could have for future sets of proceedings.

Topic: Adoption, Best Interests, and the European Court of Human Rights 

The European Court of Human Rights has come a long way in its approach to children’s welfare in the field of child protection. From inauspicious beginnings, where children were referred to as “it”, children’s interests have developed from a peripheral concern to a central tenet of the Court’s jurisprudence. This talk will analyse the Court’s approach to children’s best interests through the lens of adoption of children from care, tracing the evolution from parental rights, to competing interests, and finally, to a recognition of the paramountcy of children’s welfare. 

Speaker: Dr Claire Fenton-Glynn, Senior Lecturer in Law at the University of Cambridge.

Topic: Tax overview for Family Practitioners.

By attending this course you will gain an introductory overview of all of the key taxes and what transactions they may apply to. This will include Income Tax, National Insurance, Corporation Tax, VAT, Capital Gains Tax, Stamp Duty and Inheritance Tax. A little extra time will be spent on the Capital Gains side of things around the transfer of assets including on the impact of a change in marital status.

Topic: Conduct in financial remedy proceedings: what does it take to get ’the gasp factor'?

An overview of caselaw and relevant principles that the court will apply when determining whether conduct should be relied upon, with case studies and practical tips to advise clients.
